As of April 2013 approximately 4.4 million foreclosures have been completed in the U.S. since the subprime mortgage crisis began in 2008. In California, more than one million homes were foreclosed between 2008 and 2011. Governor Schwarzenegger, on July 8, 2008, signed SB 1137 into law. This is a foreclosure protection bill requiring lenders to contact and meet with borrowers in order to work out a solution before foreclosure occurs. The bill was passed to stem the tide of foreclosures in the State of California.
On July 11, 2012, Governor Jerry Brown signed the California Homeowner Bill of Rights into law. This law went into effect on January 1, 2013. The CHBOR was the legislative response to lenders who systematically failed to provide homeowners with the opportunity to explore loss mitigation options to avoid foreclosure and who engaged in significant mortgage servicing misconduct.
